【震惊】楼花烂尾律师破产 千万订金蒸发

  四年前购买了北约克某黄金地段楼盘的买家,满心欢喜等待收楼,殊不知等了四年,新楼盘不但未动工,连发展商也去如黄鹤。部份买家近日接获通知,代表该楼盘的律师也宣布破产,存放在该律师信託账户里的1,000多万订金不知去向。目前已有苦主到所属警局报案,寻求法律保护。

 

  家住多伦多的马先生、陈先生和高女士,分别于20102011年期间,先后购买了北约克某黄金地段楼盘Centriumat North York。这个号称集酒店、商铺和公寓于一身的复合型开发项目,由于地点好、价格平,一度热销。

 

  三位买家在集体接受本报记者专访时声称,他们在购买了该楼盘的公寓和商铺楼花后,分数次将20%的订金汇入指定信託帐号。去年910月份,他们闻说这个楼盘转手了,到了今年1月,他们收到开发商的来信,告知该项目进行不下去了。

 

  他们相约找到发信的地址,发现所在地已变更为一间车行。由于在购买该楼盘时,订金是放在律师的信託帐号里,他们自信就算项目取消,拿回订金应该不成问题。但当他们去信联系该律师时,迟迟得不到答复,最后透过代表律师发出询问,对方回复称一切都在按程序进行,不会有问题。

 

收到破产通知信

  到了今年8月初,三位买家称他们先后收到该律师的破产通知信。本报记者从他们出示的这封信中看到有如下描述:「我被聘为多伦多一公寓楼盘律师,以此身份,我以信託的方式共收到该楼盘商铺,酒店和公寓单位订金1,210万。我失误地将这笔信託资金放给了开发商,而他带着这笔钱潜逃了。」(I was retained to act as the solicitor for a builder/developer (Developer) of a condominium project in Toronto. In that capacity Ireceived, in trust, deposit monies for commercial, hotel and condominium unitstotaling approximately $12.1 million. In error I released these funds to the Developer who absconded with the funds.

 

欠额最高达60多万

  记者从三位被访者提供的破产通知信中看到,在标有过百人的债权人名单中,绝大多数为该楼盘的买家,所欠金额从几万到几十万不等,最高达60多万。而从名字的拼写看,这些买家的姓名疑似华裔。三位受访者声称:据他们瞭解,名单中9成以上是华裔。
  据本身在律师楼工作的高女士介绍,该楼盘的开发商是韩裔,其委託的代表律师也是韩裔。开发商名下有多家公司,当初向他们推销楼盘的是其名下的一家地产公司,两名销售代表也是韩裔;和他们签署购买合约的,却是其名下的一家数字公司。
